To file for divorce in New York Divorce Residency Requirements must be met. Typically, either spouse must have been a resident of New York for a continuous period of at least two years before filing for divorce. However, there's an exception: if both spouses were residents of New York on the day the divorce action is commenced and the grounds for divorce occurred in New York, then the New York Divorce Residency Requirements is reduced to just one year. This means that at least one spouse must have resided in New York for one year immediately preceding the filing of the divorce action.
